Terms and conditions

My Journal Addiction, s.r.o.

These terms and conditions govern mutual rights and obligations when concluding distance sales contracts pursuant to Act no. 102/2014 Z.z. Consumer Protection Act www.myjournaladdiction.com. The applicable law is the law of the Slovak Republic and all contracts in matters not regulated by this policy will be governed by the relevant provisions of the law of the Slovak Republic. In the event that the wording of the terms and conditions differs in other languages, the Slovak wording will take precedence.

Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any Services. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service.

Definitions

Seller means the company My Journal Addiction, s.r.o., IČO: 53988426, VAT number: 2121554611, with registered office at Pečnianska 1, 851 01 Bratislava, Slovak Republic;
The seller may be referred to as: "we or us"
The buyer is understood as a natural person (consumer) who, when concluding the contract, does not act as part of the performance of his business activity.
The buyer may be referred to as: "you"

A business partner is understood to mean a person who, when concluding a purchase or other contract, acts as part of his business activity, and contracts concluded in this way will be governed by the relevant provisions of the Commercial Code.

The goods are understood as everything that is included in the parcel, which is physically delivered to the Buyer.

A book is a pre-drawn diary.

A third country means a country that is not a member of the EU, with the exception of Northern Ireland.
To be eligible for a return, your item must be in the same condition that you received it, unworn or unused, with tags, and in its original packaging. You’ll also need the receipt or proof of purchase.

General

We reserve the right to refuse Service to anyone for any reason at any time. Content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.
The Buyer agrees not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the Service is provided, without express written permission by us.
The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

The Price

Prices for our products are subject to change without notice.
We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.
We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.

The prices for goods or services purchased by the buyer are final and include all taxes that apply to the given transaction under the Slovak law, and include VAT of an EU member state if this state is the place of delivery of goods or services. Any other taxes and duties that are collected by a third country, or any similar taxes on consumption, must be borne by the buyer.

In the case of a business partner, the price must be ascertained outside of the normal form for concluding a purchase contract, via email info@myjournaladdiction.com. The standard form does not contain all the necessary data to determine VAT liability, and the amount of the price itself depends on the location of the business partner, place of delivery or registration for VAT.
The seller is a VAT payer.

Delivery

The buyer agrees to provide current, complete and accurate purchase and account information for all purchases made at our store. The buer agrees to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete transactions and contact the buyer as needed.

Delivery is made through Slovak Post or another consignee. If the buyer, who has chosen a third country as the destination, does not take over the package within the period during which it is with the carrier, he is not entitled to a refund of postage upon withdrawal from the contract.

The buyer who does not accept the shipment with a destination within the EU economic area and requests the resending of the diary will pay the sum of 5 Euros as postage even if his purchase contract did not include the item postage due to the increased cost associated with the performance of the purchase contract.

The responsibility for the damage is borne by the Seller until the moment the Buyer accepts the shippment

Withdrawal from the contract

The buyer can withdraw from the contract within 14 days of taking over the goods, unless these terms and conditions stipulate otherwise. The buyer must send his notice of withdrawal to the email address info@myjournaladdiction.com no later than the last day of the 14 term. Notifications sent after the deadline will not be considered. After sending notification the buyer has to send the goods within 5 working days. 
The buyer cannot withdraw from the contract if the subject of sale is:
electoral data in the form of video recordings, pdf files or pictures and software;
customized or custom-made goods;
If the buyer withdraws from the contract after receiving the goods, he is obliged to send the goods undamaged to the Seller at his own expense.

Warranty and complaints

The warranty period for goods purchased by the buyer is 24 months.
The warranty does not cover normal wear and tear caused by use.
The seller is responsible for defects that the goods have upon receipt. In this case, the buyer has the right to return the goods free of charge, exchange them for a new item or receive a reasonable discount depending on the defect.

To apply for a claim, the buyer must provide proof of payment, either in the form of a payment receipt or a tax document.
The buyer needs to provide cooperation in form of sending pictures or videos of damage if required by the seller.
The buyer can exercise his rights at info@myjournaladdiction.com.
The buyer has the right to a complaint procedure, which does not last longer than 30 days, and at his request, a written statement on the assessment of the complaint can be prepared.

The warranty period for goods purchased by a business partner is the subject of the agreement, but at least 12 months.

Errors, inaccuracies and omissions  

Occasionally there may be information on our site or in the Service that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice
